A Practical Strategy for Same-Sex Divorce in Orange County

We begin by examining the circumstances that can shape your divorce, including the history of the marriage, marital property, parenting concerns, and each spouse’s priorities. Your lawyer develops an in-depth understanding of your situation so that our recommendations remain focused on the issues that matter in your case.

Some disputes can be resolved through negotiation or mediation. Others require litigation to protect a client’s position and present contested issues to the court. We assess the circumstances pragmatically rather than treating every divorce as though it should follow the same path.

Dennis R. Vetrano, Jr., Esq. is a certified mediator with an extensive amount of New York legal experience. His background includes divorce, litigation, collaborative family law, and mediation. We also bring trial experience to cases that require court intervention.

How New York Law Treats Same-Sex Divorce

New York Domestic Relations Law § 10-a requires marriages of same-sex and different-sex couples to receive equal legal treatment. The same divorce framework therefore governs grounds, equitable distribution, maintenance, and parenting arrangements.

New York also recognizes qualifying same-sex marriages legally performed outside the state before New York legalized same-sex marriage. In those cases, the original wedding date may affect the duration of the marriage and the analysis of financial issues.

Residency Requirements for Filing for Divorce

Before filing, a spouse must satisfy one of the residency conditions under § 230 of that law. The applicable condition depends on where the marriage occurred, where the spouses lived as a married couple, where the basis for divorce arose, and how long one or both spouses have continuously resided in New York.

Requirements are as follows:

  • You or your spouse has lived in New York for at least two years immediately before filing for divorce.
  • Both you and your spouse live in New York when you file for divorce, and the grounds for divorce occurred in the state; or
  • You or your spouse has lived in New York for at least one year immediately before filing for divorce, and one of the following applies:
    • You were married in New York.
    • You lived together as spouses in New York during your marriage.
    • The grounds for divorce occurred in New York.

You must meet one of the above residency requirements. Our Orange County same-sex divorce lawyer can help you determine whether you meet residency requirements and help you take the next steps.

Property, Debt & Financial Support

New York permits a no-fault divorce under § 170(7) when the marital relationship has broken down irretrievably for at least six months. This addresses the legal ground for ending the marriage, but spouses must still resolve the related financial and child-related issues.

Under § 236(B)(5), New York follows equitable distribution for marital property. Equitable means fair under the relevant circumstances, not necessarily an equal division. Identifying marital property, valuing applicable assets, and distributing debt can require detailed financial analysis.

Spousal support may also be disputed. The amount and duration, if any, depend on the governing law and the facts presented. We assess these questions as part of the broader divorce strategy rather than assuming one resolution fits every marriage.
