Hudson Valley Military Divorce Counsel Attuned to Service Obligations
Military divorce requires careful attention to federal benefit rules, New York family law, and service obligations that can disrupt court schedules. The Law Office of Dennis R. Vetrano, Jr., LLC represents service members and civilian spouses in matters involving military pensions, Survivor Benefit Plan elections, and custody affected by military duties.
Senior Partner Kristen D. Farris has extensive experience handling complex divorce and family law matters for military families. Our attorneys and legal professionals provide personal attention while accommodating clients who are deployed, stationed elsewhere, or unable to communicate in person.

How We Approach a Hudson Valley Military Divorce
We begin by reviewing the service member’s record, the family’s circumstances, and any immediate legal concerns. This assessment helps us identify filing options and time-sensitive issues connected to a current deployment or anticipated military orders.
We consider negotiation or mediation when either method fits the circumstances, while preparing thoroughly for litigation when contested issues require court involvement. If military obligations interfere with participation, we can seek appropriate scheduling accommodations from the court.
Communication During Deployment or Stationing
Distance doesn’t prevent a client from receiving informed legal counsel. We use telephone and video conferencing to communicate with clients stationed away from the Hudson Valley or deployed elsewhere. In-person consultations are also available.
Military duties can affect access to documents, availability for conferences, and participation in proceedings. We identify these concerns early and account for them in the case strategy.
Military Retirement & Federal Benefits
We address military pensions under the Uniformed Services Former Spouses’ Protection Act, the federal law that permits state courts to treat qualifying military retirement benefits as marital property. We apply that framework alongside New York equitable distribution rules and prepare Military Pension Division Orders when required.
The 10/10 rule is frequently misunderstood. It concerns eligibility for direct payment from the Defense Finance and Accounting Service when marriage and creditable military service overlapped for at least 10 years. It doesn’t determine whether a New York court may divide military retired pay.
Military financial issues that may require specific attention include:
- Survivor Benefit Plan elections
- Division of Thrift Savings Plan assets
- TRICARE eligibility after divorce
- Continued base and commissary privileges
- Qualified Domestic Relations Orders and Military Pension Division Orders
Direct payment to a former spouse under the Uniformed Services Former Spouses’ Protection Act is generally limited to 50 percent of disposable retired pay. Combined payments involving child support or alimony garnishment may reach 65 percent. A former spouse who satisfies the 20/20/20 rule may retain full TRICARE, commissary, and exchange benefits, but eligibility depends on the applicable service and marriage history.
Parenting Time, Custody & Support During Military Service
Deployment, reassignment, and changing orders can affect parenting-time logistics, parent-child communication, and participation in court proceedings. During our initial review, we identify known deployment concerns and anticipated orders that may affect a custody or support case.
Temporary arrangements may be necessary when service obligations alter a parent’s location or availability. We prepare for negotiation, mediation, or litigation based on the family’s circumstances without assuming that military service alone determines a custody outcome.
The Uniformed Services Former Spouses’ Protection Act may also permit enforcement of child support and alimony awards regardless of the marriage’s length. The rules for retirement division and direct payment are distinct from the enforcement provisions that apply to family support.
Stays Under the Servicemembers Civil Relief Act
The Servicemembers Civil Relief Act provides protections before a court may enter a default judgment against a service member who hasn’t responded to a divorce filing. A default judgment is a decision entered when a party fails to answer or participate as required.
A service member may request a stay, or temporary pause in a civil proceeding, when military service materially affects the ability to participate. A qualifying request receives an initial 90-day stay and may support an additional stay. Whether these protections apply depends on the service member’s circumstances and compliance with federal requirements.
Equitable Distribution & Military Asset Division
New York follows equitable distribution, which means the court divides qualifying assets fairly according to the circumstances rather than automatically dividing them equally. Marital property generally includes assets acquired by either or both spouses during the marriage and before a separation agreement or the commencement of a matrimonial action, regardless of whose name appears on the title.
Courts consider statutory factors when distributing these assets, including the duration of the marriage, each spouse’s age and health, and each spouse’s contributions. Military retirement benefits and the Thrift Savings Plan may require analysis under both state principles and the federal rules governing the particular benefit.
Military divorces in Dutchess County may involve Supreme Court for contested divorce issues and Family Court for temporary custody and support orders. Our attorneys know how to work with local clerks, court staff, and relevant agencies while addressing the procedural requirements of military family law cases.
